By accessing and using BulkSMSPro ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
BulkSMSPro is an SMS messaging platform that allows users to send bulk SMS messages, manage contacts, create campaigns, and access SMS-related analytics. The Service is provided on an "as is" and "as available" basis.
3.1 Account Creation: You must provide accurate, current, and complete information during registration and keep your account information updated.
3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3 Account Suspension: We reserve the right to suspend or terminate your account if you violate these Terms of Service or engage in fraudulent, abusive, or illegal activity.
4.1 Credits: The Service operates on a credit-based system. You must purchase credits to send SMS messages.
4.2 Pricing: Credit prices are subject to change. We will notify you of any price changes with reasonable advance notice.
4.3 Refunds: All credit purchases are final. Credits are non-refundable except as required by law or at our sole discretion.
4.4 No Refunds for Used Credits: Once credits are used to send messages, they cannot be refunded.
You agree not to use the Service to:
6.1 Approval Process: All sender IDs must be approved by our team before use. We reserve the right to reject any sender ID that violates our policies or applicable regulations.
6.2 Format Requirements: Sender IDs must be 4-11 alphanumeric characters and comply with carrier requirements.
6.3 Prohibited Content: Sender IDs cannot contain offensive, misleading, or trademarked content without proper authorization.
7.1 API Keys: API keys are provided for programmatic access to the Service. You are responsible for keeping your API keys secure.
7.2 Rate Limits: API usage is subject to rate limits. Excessive usage may result in temporary or permanent suspension of API access.
7.3 Abuse: Any abuse of the API, including but not limited to automated abuse, scraping, or attempts to circumvent rate limits, is strictly prohibited.
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or unforeseen circumstances. We are not liable for any damages resulting from Service unavailability.
9.1 Delivery Guarantees: While we strive for high delivery rates, we cannot guarantee 100% message delivery. Delivery rates depend on various factors including carrier policies, recipient phone status, and network conditions.
9.2 Failed Messages: Credits are deducted when messages are sent, not when they are delivered. Failed messages may be retried at our discretion, but credits are not refunded for failed deliveries.
9.3 Delivery Reports: We provide delivery status reports, but these are estimates and may not always be accurate.
The Service, including its original content, features, and functionality, is owned by BulkSMSPro and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of the Service without our express written permission.
To the maximum extent permitted by law, BulkSMSPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
You agree to indemnify and hold harmless BulkSMSPro, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any rights of another.
13.1 By You: You may terminate your account at any time by contacting our support team.
13.2 By Us: We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
13.3 Effect of Termination: Upon termination, your right to use the Service will immediately cease. All remaining credits in your account will be forfeited unless otherwise required by law.
We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BulkSMSPro operates, without regard to its conflict of law provisions.
